1. Introduction Welcome to Dutch Daily! These Terms of Service (“Terms”) govern your access to and use of our website, application, products, and services (collectively, “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Services.
2. Eligibility You must be at least 18 years old or have reached the age of majority in your jurisdiction to use our Services. By using our Services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration & Security To access certain features of our Services, you are required to register for an account. You agree to provide accurate, complete, and current information during the registration process. Your account is strictly personal. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Sharing your login details with third parties is strictly prohibited and may result in immediate suspension or termination of your account without a refund.
4. Acceptable Use of Services & Abuse You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

Infringe upon or misappropriate the intellectual property rights of others.
Post, transmit, or distribute any content that is harmful, offensive, or inappropriate.
Use automated scripts, spiders, bots, or any other means to scrape, harvest, or extract data from our Services.
Engage in any activity that could interfere with, disrupt, or put an unreasonable load on the functioning of our Services (including our API integrations).
Any form of abuse, unauthorized access, or violation of these rules will be strictly monitored and may be reported to the relevant authorities. Dutch Daily reserves the right to take legal action against such violations under Dutch law.
5. AI Features and Fair Use Dutch Daily utilizes artificial intelligence (AI) to provide features such as dynamic lesson generation, interactive bots, and speech synthesis.
Accuracy: While we strive for high-quality content, AI-generated responses may occasionally contain inaccuracies, errors, or unnatural phrasing. Dutch Daily is not liable for any misunderstandings or errors arising from AI-generated content.
Fair Use: Access to our AI-powered features is subject to a Fair Use Policy. We reserve the right to limit, restrict, or suspend access to AI features for users who generate an abnormally high volume of requests that negatively impact our server capacity or API limits.
6. Intellectual Property Rights All content and materials available through our Services, including text, graphics, logos, icons, images, software, and AI-generated lesson structures, are the property of Dutch Daily or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content or materials without our prior written consent.
7. User-Generated Content You may have the opportunity to submit content, including text (such as diary entries or writing assignments), through our Services (“User Content”). By submitting User Content, you grant Dutch Daily a non-exclusive, royalty-free, worldwide license to use, reproduce, and process your User Content strictly for the purpose of operating and improving our Services (e.g., AI grammar corrections). You represent and warrant that you have the rights to submit the User Content and that it does not infringe upon the rights of any third party.
8. Subscriptions, Fees, and Cancellations Some of our Services are offered on a subscription basis. By purchasing a subscription, you agree to pay all applicable charges, including taxes, in accordance with the billing terms in effect at the time of purchase.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
Changes: Dutch Daily reserves the right to modify, add, or remove subscription plans, features, and pricing at any time without prior notice.
Cancellations: If you feel that the updated subscription plans or features no longer suit your needs, you always have the right to cancel your subscription. You can easily do this at any time through your account dashboard or by emailing us. Cancellation will take effect at the end of your current paid billing period.
9. Termination Dutch Daily reserves the right to suspend or terminate your access to our Services at any time and for any reason, including if you violate these Terms or our Fair Use Policy. Upon termination, all rights granted to you under these Terms will cease immediately, and you must cease all use of our Services.
10. Disclaimers Our Services are provided “as is” and “as available” without any warranties, express or implied. Dutch Daily does not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. Your use of our Services is entirely at your own risk.
11. Limitation of Liability To the fullest extent permitted by law, Dutch Daily and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or other damages, arising out of or in connection with your use of our Services.
12. Indemnification You agree to indemnify, defend, and hold harmless Dutch Daily and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your use of our Services or your violation of these Terms.
13. Governing Law & Jurisdiction These Terms and your use of our Services will be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of laws principles. Any legal disputes, including those arising from platform abuse or terms violations, will be handled exclusively by the competent court in Amsterdam, The Netherlands.
14. Changes to These Terms Dutch Daily may update these Terms from time to time. We will notify you of any changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of our Services after the changes take effect constitutes your acceptance of the new Terms.
